Cost in the case of late payments

If you miss a payment, we will charge you our reasonable legal costs if we have to enforce the agreement. We will charge you our reasonable charges for:

(a) Making arrears telephone calls, emails or mobile text messaging or for sending arrears letters, reminders or documents to which you are not entitled – £10.00 for each instance.
(b) Tracing you if you move address without notifying us, carrying out a visit to your home address or finding the vehicle if not at the address given by you – £75.00 for each instance.
(c) Cheques/standing orders/direct debits and credit/debit card payments which are dishonoured, stopped or not paid by you – £20.00 for each instance.

We will notify you of any changes in the amounts before the come into effect.

Consequences of missing payments

If you miss or make late payments we can (after the service of an appropriate notice under the Consumer Credit Act of 1974) end the agreement and take back the vehicle.

If the agreement ends you must pay us all the payments that you still owe us plus the balance of the total amount payable in respect to the Hire Purchase agreement.

We may take legal action to enforce County Court Judgement against you.

If you miss any payments it is possible that this will make it more difficult to obtain credit in the future. We may pass details of any default by you to a credit reference agency.

4.Other important legal aspects

You have the right to withdraw from the credit agreement before the end of 14 days beginning with the latest of:

  • The day after the day on which the credit agreement is made ;or
  • The day on which we provide you with a copy of the executed credit agreement.

Default Charges

If you miss a payment we will charge you our reasonable charge for:

Ombudsman

You have the right to complain to the Finance Ombudsman. Before you complain to the Ombudsman you must inform us of your complaint and allow us 60 days to resolve your financial issue. If after 60 days an outcome has not been reached, you can contact the Ombudsman.

Security

You agree that if there is a claim under a contract of insurance, the Insurer can pay monies under a claim to us which we can apply against you liabilities under this agreement. If you receive any Insurance money you must hold it on trust for us.

Termination: YOUR RIGHTS

You have the right to end this agreement. To do so, you should call Kashijan Vehicle Limited. Then you will be entitled to the return of the goods. This does not affect any of your consumer rights.

AGREEMENT (HIRE PURCHASE)

We agree to hire to you and you agree to take on hire the goods detailed on your hire purchase agreement which you have signed for.

PAYMENT

You have agreed to pay a deposit as detailed on the Hire Purchase agreement section A2 as shown.

You agree to pay us:

  • The total amount payable including any deposits and monthly payment for the whole period of the agreements as agreed.
  • It is vitally important you make you monthly instalments in full and on time as agreed and detailed in this agreement. Failer to do so can impact your credit rating and make it difficult to obtain credit in the future.
  • As agreed, there is an arrangement fee applied to this agreement which you have agreed to pay as part of your monthly payments.

OWNERSHIP OF THE VEHICLE

We are the owners of the vehicle and you hire it from us. This is until you make your final payment where you then become the owner on the vehicle and we have no further financial interest in the vehicle. Until this point, if you fail to maintain your payments we can take back the vehicle as we are the owners until the entire balance it paid. You name may appear on your V5 document issued from the DVLA and you are responsible for RFL on the vehicle.

DELIVERY OF YOUR VEHICLE

You must examine your vehicle when collecting vehicle or when vehicle is delivered to you. Any issues on the vehicle before delivery can not be considered. In signing your agreement, you are confirming you are happy with the condition on the vehicle which has been present to you.

INSURING THE VEHICLE

You must:

Make sure the vehicle whilst under this agreement has a full comprehensive motor insurance policy. You must let your Insurer know of any losses or damages to your vehicle no longer than 48 hours after incident. Any monies paid from any Insurance company should be made payable to us as the owners of the vehicle.

CARE OF THE VEHICLE

You must:

Keep your vehicle in good working order and repair at all expense to yourself. The vehicle need to be serviced regularly at it correct service intervals. (For more information on servicing please contact the manufacture of the vehicle) The vehicle should also hold a current and valid MOT. You are not allowed to take the vehicle out of the county for more the 28 days with notifying us.  You must notify us if your vehicle is not going to kept at your home address as we have been made aware of. You must not use the vehicle for private hire, speed testing or as a local authority vehicle.

DATA PROTECTION ACT

Kashijan Vehicle Limited is a registered company with the ICO. We hold your personal details and will not give information to any third party for profitable or financial reasons. The only companies we will share information with are details below:

  • CREDIT REFERENCE AGENCIES – If you fail to make payments, We will inform credit reference agencies of your default payments. We also will share information with credit reference agencies when agreement is completed and successful payments have been made.
  • RECOVERY DEBIT MANAGEMENT – If you fail to make payments on your agreement, we can pass your details onto a debit recovery company to recover all of our financial losses.

OUR RIGHT TO END THIS AGREEMENT AND/GET BACK THE VEHICLE

We can (subject to serving you notice) to end this agreement at anytime. We can only exercise this right if we at a financial loss due to you making non payment for the delivered good. In this case we can request the balance to be paid in full and/or request the vehicle to be back into our possession. In both cases we need to serve you notice.

SERVING NOTICE OF END OF THE AGREEMENT

If you fail to pay for the good and keep up with your regular monthly payments, we can serve notice for full payment, or request for the vehicle to be back into our possession. In this case we will orally inform you of our action. We will also write to you and allow you 14 working days to either:

  • Pay the balance in full to Kashijan Vehicle Limited AND OR:
  • Return to vehicle to us, or arrange collection of the vehicle.

If we need to arrange to collect this vehicle you will be subject to a £750.00 transportation cost.

DEALER/SUPPLIER’S WARRANTY

As part of this credit agreement, Kashijan Vehicle Limited will supply a offer of warranty on the vehicle sold. The will include a 3 months engine a gearbox warranty. We will for the first 30 days of the vehicle being in your possession offer a full warranty.

For this warranty to be valid you must make sure the vehicle is in a road worthy condition. Within this, the vehicle must also hold a MOT. This warranty will exclude any wear and tear items, such as tyres, brakes etc. This warranty also will exclude any bodywork. Bodywork is not included even within the first 30 days. If you need to claim on this warranty, it is your responsibly to return the vehicle to Kashijan Vehicle Limited to we can correct the fault that has occurred to the vehicle. Any unauthorised work carried out will not be covered under any part of this warranty.

If you accept this warranty and the term of this warranty, please sign is place stated below. Kashijan Vehicle Limited will also sign to agree to applying warranty on this vehicle as part of this credit agreement.

Agreement for installation of the payment reminder system
and disclosure statement to customer

PLEASE READ THIS ENTIRE AGREEMENT AND DISCLOSURE – IT DESCRIBES THE REQUIRED PAYMENT AND THE CONSEQUENCES OF FAILING TO MAKE PAYMENT.

This agreement and disclosure statement forms part of the agreement between you and Kashijan Vehicle Limited.

The payment reminder system requires the customer to enter a nine digit code before the vehicle will re-start. The code will change each month, and each month a new code will only be provided once payment has been received.  By signing this document the customer agrees to the system’s installation and to its use until all of the customer’s obligations under the contract are satisfied. When the contract is satisfied, the system will be removed from the vehicle at no added cost.

THE VEHICLE WILL NOT START WITHOUT THE CORRECT CODE.

THE CORRECT CODE WILL BE PROVIDED ONLY ONCE PAYMENT IS RECEIVED.

PLEASE READ AND INITIAL EACH OF THE FOLLOWING STATEMENTS:

I understand, agree and consent that the system has been installed in the vehicle; and that I had the freedom to purchase a vehicle from another source, which may not have required installation of this system.

I understand and agree that the installation and maintenance of the system in the vehicle is a material condition for the lender to finance the purchase of the vehicle or lease the vehicle, and as such constitutes partial consideration for the terms of the contract.

I understand and agree that the system belongs to the lender at all times.

I understand that if my payment is not received within 7 days of the due date, I will need to phone the lender to obtain a daily driving code until I have complied with the notice of default issued.

I understand and agree that if a scheduled payment is not received by the lender THE VEHICLE WILL BE DISABLED AND WILL NOT RESTART until payment is received by the lender and a new code is issued.

I understand and agree that the installation and maintenance of the system in the vehicle is a material condition for the lender to finance the purchase of the vehicle or lease the vehicle, and as such constitutes partial consideration for the terms of the contract.

I understand and agree that if I do not make a scheduled payment, if I default on any of my contractual obligations or if I tamper, alter, disconnect or remove the system in my vehicle the lender may take steps to REPOSSESS THE VEHICLE in accordance with the terms of my contract due to I will be in breach of this contract.

I understand that the use of this system does not constitute Kashijan Vehicle Ltd exercising rights under the section 90 of the Consumer Credit Act 1974, and the continued usage of the vehicle, if appropriate, is granted by contacting Kashijan Vehicle Ltd customer services.
